Welcome to LexCard. These Terms of Service govern your use of the LexCard website and pre-application services operated by Gingham Holdings, Inc. d/b/a Lex ("Lex," "we," "us," or "our"). By accessing or using our services, you agree to be bound by these terms.

1. Acceptance of Terms

By accessing or using the LexCard website, submitting a pre-application, or interacting with our services through any channel (including WhatsApp), you agree to these Terms of Service and our Privacy Policy. If you do not agree, please do not use our services.

2. Description of Service

LexCard currently operates a waitlist and pre-application platform for a premium US-issued credit card designed for global citizens. Our service is in a pre-launch phase. By submitting a pre-application, you are expressing interest in a product that is not yet generally available. The pre-application does not constitute a binding agreement for any financial product or service.

3. Eligibility

To submit a pre-application, you must be at least 18 years of age and legally able to enter into binding agreements in your country of residence. You must provide accurate, complete, and current information during the pre-application process.

4. User Obligations

You agree to provide truthful and accurate information in your pre-application. You agree not to use our services for any unlawful purpose or in any way that could damage, disable, or impair our services. You are responsible for maintaining the confidentiality of any account credentials and for all activities that occur under your account.

5. Intellectual Property

All content, trademarks, logos, and intellectual property displayed on the LexCard website are the property of Gingham Holdings, Inc. d/b/a Lex or its licensors. You may not reproduce, distribute, modify, or create derivative works from any content on our website without our prior written consent.

6. No Guarantee of Product Features

LexCard is a financial technology company, not a bank. Card products, if and when launched, will be issued by regulated banking partners pursuant to a pending license from Visa. All product features, benefits, pricing, and availability described on our website or in our communications are subject to change and are contingent on the finalization of partnerships and licensing agreements. Nothing on our website constitutes a binding offer or guarantee of any specific product or feature.

7. Limitation of Liability

To the maximum extent permitted by applicable law, LexCard and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or other intangible losses, arising out of or in connection with your use of our services.

8. Disclaimer of Warranties

Our services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
